Marine plants and community infrastructure development – 2016

A proposed development of a community rugby pitch triggered concerns by the developer as one edge of the site was lined with trees that could be considered marine plants. All marine plants are protected under the Fisheries Act 1994. The removal of marine plants triggers additional requirements in terms of assessment of the development and could potentially require an offset under the Environmental Offsets Act 2014.  However Biotropica Australia used an on-site botanical survey, plus detailed knowledge of environmental legislation to negotiate an outcome that both allowed the timely development of the community infrastructure, and increased the environmental value of the vegetation surrounding the site.
